Obstructing a Public Business Establishment Case Completely Dismissed! Penal Code section 602.1(a) “Obstructing a Public Busines

|

Recently, in Los Angeles County at the Airport Courthouse our office successfully negotiated for a complete dismissal of our client’s Penal Code section 602.1(a), “Obstructing a Public Business Establishment” misdemeanor offense.

According to the police reports, our client entered a public government building and refused to leave after alleging causing a disturbance and being told by security that he was no longer permitted at the location. Security was called to monitor our client and the police arrived shortly thereafter and arrested our client.

Our office subpoenaed the video surveillance footage from the government building and, after reviewing the video, it appeared that the security officer did not in fact ask our client to leave, as he alleged in the report. Thus, we provided this information to the prosecution and requested they dismiss the matter.

After reviewing the video footage, the prosecution dismissed the matter in the interests of justice, pursuant to Penal Code section 1385.

This is a great result for our client and he will now be able to move forward with sealing his record of arrest pursuant to Penal Code section 851.91.
