Misdemeanor DUI Case Involving .13/.14 PAS Test - 0.9/.11 Chemical Test With a Freeway Traffic Collision Reduced to a “Wet Reckl

Our client was initially contacted by law enforcement after causing a two-car vehicle collision at 2 a.m. on the I-710 Freeway. When law enforcement responded to the scene, the other party was being transported to the emergency room after having been rear-ended by our client and suffering major vehicle damage and back and neck pain. When our client rear-ended the other vehicle on the freeway, the other vehicle lost control due to the impact and spun into the center freeway median divider.

When law enforcement contacted our client, they smelt the odor of alcohol on her breath and asked our client to comply with field sobriety testing. Our client did not perform well on the testing and was asked to submit to a preliminary alcohol screening (“PAS”). Our client blew a .13/.14 and was placed under arrest. Our client also suffered bodily injury and was transported to the hospital. Prior to being transported to the hospital, she agreed to submit to a chemical test at the station in which she blew a .09/.11.

After receiving the discovery for the case and after reviewing the videos relating to the arrest, we gathered equitable documentation on behalf of our client and provided it to the prosecution. After negotiation with the prosecution, and despite the fact that there was a serious vehicle collision in this matter, we were able to negotiate for a reduced plea to a wet reckless charge with no jail time!
