Our client contacted our office after she had been struck by a vehicle when she was crossing the street as a pedestrian. The defendant failed to yield to our client lawfully walking within the crosswalk and struck her with his vehicle, causing her to fracture her ankle from the impact of her fall. Our client suffered an “oblique, nondisplaced fracture at the distal fibular metadiaphysis with slight lateral displacement of the proximal fracture fragment” and had to be in a cast for over thirty-seven (37) days to allow her ankle to heal. Our client had to seek medical treatment at an emergency room immediately after the accident and she required medical treatment from an orthopedic surgeon and extensive physical therapy to regain full use of her leg. Ultimately, our client did not require surgical intervention but had to be placed in the cast and a boot to avoid the need for surgery. Our client was rendered totally disabled from work for sixty-three (63) days and had to use her vacation and sick leave to allow her the time that she needed to heal from her injuries.
In this matter, we were able to quickly establish that the other party was completely liable for the damage and began to form a line of communication with the party’s insurance company. We were able to quickly gather the medical documentation detailing the extent of our client’s injuries and we were able to clearly and concisely pinpoint the amount of loss wages our client was suffering as a result of being rendered “totally disabled” from work.
When it came time to negotiate settlement with the opposing party, we vigorously fought for our client to be fully compensated for her loss wages and we were able to significantly increase the offer from the defendant’s insurance company from their original offer.
Our client has received significant compensation for her injuries and has fully regained the loss wages that she had to use to heal from this incident! Our office was able to negotiate a settlement award for our client that was almost seven times the medical costs she had incurred to treat her injuries!
