Recently, in Los Angeles County at the Compton Courthouse our office successfully litigated a Penal Code § 1203.4 motion to dismiss our client’s 2016 conviction for violating Vehicle Code section 23152(b), “Driving Under the Influence.”
Our client voluntarily departed to El Salvador after being placed in deportation proceedings and being housed in immigration detention. Our client hired our office to assist in bettering his record in an effort to be re-admitted into the United States. In our motion, we provided proof that our client had completed all of his sentence and probation requirements, had children in the United States, had adverse immigration factors, and was not currently charged with any new offenses.
After reading our motion, the court indicated that it was inclined to grant our motion and the prosecution did not oppose. Thus, the motion was granted and our client’s Vehicle Code section 23152(b) offense was granted!
