Juvenile Client Charged with Violating Penal Code section 192(c)(1), “Vehicular Manslaughter” – a Felony - Juvenile Jurisdiction

|

Last year our client was charged with violating Penal Code section 192(c)(1), felony Vehicular Manslaughter, after allegedly engaging in “speed racing” with another minor which resulted in the tragic death of a nearby jogger.

At the onset of the case, given the seriousness of the charges and the fact that a life was lost as a result of the incident, the prosecution wanted our client committed to juvenile prison. Through strenuous litigation and negotiation, attorney Steve Escovar was able to negotiate for a “home on probation” disposition that would allow our client to avoid confinement in prison and remain in his home under the supervision of his parents and the probation department. In order to achieve this result, we presented the prosecution with a motion showing our client’s active participation in extracurricular activities at his high school, his good grades, his acceptance into college, and his involvement in volunteering within the community.

After admitting the charges, our client was ordered to complete community service and comply with other requirements of probation.

Recently, after approximately one (1) year of court supervision, our client successfully completed the requirements of the court and probation and juvenile jurisdiction was terminated. Our client’s case was then sealed!

With this result, our client can move forward with finishing his education and obtaining a fruitful career, without this offense causing him long-term prejudice.
