Informal Diversion Granted for Client Charged with Misdemeanor “Prostitution” in Violation of Penal Code section 647(b)(2) - Cas

Our client was charged with violating Penal Code section 647(b)(2), “Engaging in an Act of Prostitution” after being arrested for allegedly soliciting sex from an undercover police officer during an operation conducted by the Los Angeles Police Department - Human Trafficking Task Force. Our client had recently immigrated to the United States from Mexico and our primary goal in defending this matter was avoiding any potential adverse federal immigration consequences.

After consulting with our client’s immigration counsel, we were able to negotiate with the prosecution to place our client in a deferred entry of judgment (DEJ) program for the offense. Our client was ordered to complete a sex education class and an AIDS test and had to remain crime-free for one year. After one year, our client successfully completed all of the conditions of DEJ and his plea was withdrawn, the case was completely dismissed pursuant to Penal Code section 1385, and his record of arrest was sealed pursuant to Penal Code section 851.91.

This is a great result for our client that will allow him to effectively state that this arrest and case did not occur!
