Informal Diversion Granted for Our Client Charged with a Violation of Penal Code Section 459.5 Misdemeanor! Case Dismissed after

Our office was recently retained to represent a client involved in an incident that resulted in a citation for violation of Penal Code section 459.5, “Shoplifting.”

In the police reports provided in discovery, it was alleged that our client stole approximately $269 worth of items from Target. It was further alleged that our client had her minor son with her at the time of this incident. After review of the audio and video related to this matter, it is clear that our client placed numerous electronic items in her cart and left the store without purchasing the items. In an interview with the Target Loss Prevention Officer, our client admitted to the conduct and was arrested by responding officers.

Our office prepared a mitigation package to present to the prosecution detailing that our client had no prior record, was working full-time, and had character letters describing her good nature. We also explained to the prosecution that the surveillance video of the offense showed that our client was under the direction of her husband at the time of the conduct.

After presenting this mitigation package and argument to the prosecution, the prosecution agreed to the informal diversion program that we proposed and after six months of no new offenses and successful completion of the two days of community labor, the offense was dismissed in the interests of justice!

This is an excellent result for our client resulting in no conviction and a complete dismissal!
