Penal Code § 273.5, Domestic Violence Felony Offense Resolved as a Penal Code § 243(e)(1), Domestic Battery Misdemeanor!

Our office was recently retained to represent a client, who before charges were filed, was under investigation for an allegation of Domestic Violence. At the pre-filing stage of the case, the prosecutor intended to file a Penal Code § 273.5, Domestic Violence, felony charge.

Considering that no charges were filed yet, our office promptly gathered equitable documentation from the client, such as proof of employment and character reference letters. We sent these documents as an Equities Package for the prosecutor to review before filing. Ultimately, the prosecutor decided to file the Penal Code §273.5 charge as a misdemeanor offense.

In order to further negotiate this matter, our office then met with the Deputy District Attorney in Charge. After careful consideration and negotiation, the prosecutor agreed to allow our client to plead to Penal Code §243(e)(1), a Battery Against a Cohabitant misdemeanor.
