Dismissed! Willfully and Unlawfully Keeping a Disorderly House for the Purpose of Prostitution (Penal Code § 316) Charges Dismis

Recently at the Van Nuys Courthouse in Los Angeles County I was able to negotiate a Penal Code Section 1385 dismissal in the interests of justice for our client charged with a misdemeanor count of violating Penal Code section 316 (“Willfully and Unlawfully Keeping a Disorderly House for the Purpose of Prostitution”).

Our client is the manager of a motel and was arrested after he rented a room to undercover officers posing as people renting the room for the purpose of prostitution.

The police reports provided a narrative from the undercover officer summarizing his interaction with our client. According to the police report, it appeared clear that our client had been made aware that one of the undercover officers was posing as a prostitute.

However, what the officer described in his written report was not consistent with the video footage our client provided us. Our office then provided the prosecution with this video footage and a mitigation package detailing our client’s good character.

At the final appearance date on the case, the prosecution dismissed the charges in the interests of justice (Penal Code section 1385) after considering the footage and mitigation package provided by our office.
