My client was originally charged in Count 1 with a violation of VC § 12500(a) misdemeanor offense for driving without a license. At the first appearance on the matter, I informed the prosecution that my client had no prior criminal history and now had his valid California driver’s license. We put the matter over to provide the prosecution with additional equities on my client’s behalf for their consideration.
Based on the numerous equitable factors on my client’s behalf, I provided an equities package to the prosecution in an attempt to obtain a dismissal or a reduction of the offense to a misdemeanor.
After review of the equities package, the prosecution was impressed with the documents presented and the fact that my client had his valid driver’s license. The prosecution agreed to dismiss the charges in the interests of justice.
After only two court appearances, we were able to obtain a dismissal for my client! Due to our diligent advocacy we were able to obtain not just a reduction to an infraction but a complete dismissal. Great result!
