Two Counts of Misdemeanor Penal Code section 484(a) Petty Theft Offenses Dismissed per Penal Code section 1382! No Jail/No Convi

Recently at the Pasadena Courthouse in the Los Angeles County, I was able to get a dismissal on behalf of my client for her 2001 offense of Petty Theft in violation of Penal Code section 484(a).

When my client hired my office, she had an outstanding warrant for failing to appear at her arraignment in 2001 without sufficient excuse. Since the charged offense was a misdemeanor, we were able to appear pursuant to Penal Code section 977, without our client present. We placed the matter on calendar and were able to recall the bench warrant and discuss the underlying facts with the prosecution.

We presented the prosecution with evidence that our client had no other criminal convictions or arrests since this incident. We highlighted that this case is over seventeen (17) years old. We explained that the total loss was calculated at approximately $26.25 and our client admitted to offense during her initial conversation with law enforcement. We argued that all these factors weighed in favor of a dismissal of the charges.

The prosecution wanted time to review the file, and after reviewing the police reports, he agreed to dismiss the charges!

With this dismissal, our client will not have to serve any jail time and there is no conviction on her record! We were able to get this result without our client ever having to go to court!
