Recently, at the Central Courthouse in Los Angeles County, I was able to withdraw my client’s plea and dismiss the conviction pursuant to Penal Code section 1203.43.
When our client hired our office, he had already sought counsel to seek post-conviction relief on his behalf. Although our client had been able to re-negotiate his original charges to a Health and Safety Code section 11350(a) offense, he was still suffering immigration consequences from the offense.
Our office filed a Penal Code section 1473.7 motion seeking to vacate the sentence in this matter. Our motion was granted and the client was re-sentenced to a Deferred Entry of Judgement program.
After successfully completing the Deferred Entry of Judgment program, we filed a motion to withdraw the plea and dismiss the conviction pursuant to Penal Code section 1203.43.
The motion was granted at the hearing! With this result, our client is one step closer to petitioning for immigration relief!
