Recently at the Clara Shortridge Foltz Courthouse, my client was charged in Count 1 with a violation of Penal Code § 487(b)(3), Grand Theft by Embezzlement. This charged offense exposed my client to potential prison custody for a maximum time of three (3) years.
Law enforcement investigation revealed, and our client provided a written confession, indicating that he had embezzled more than $25,000 over a five-month period from his employer. Our client was an employee of an armored car transportation vehicle company and had taken the money during the course of his employment.
We presented equitable documentation showing that our client had no prior criminal history, had an infant child and wife and had obtained new employment since his offense.
We pled open to the judge for a probationary sentence and were able to obtain a no jail probationary sentence in exchange for the client completing 150 hours of community service. We also were able to negotiate for an agreement that once restitution to the victim was paid, our client could reduce the offense to a misdemeanor.
This is a great no prison disposition for our client!
